These Terms & Conditions govern your access to and use of our website, services, and products. By using our website or placing an order with Dailey’s, you agree to be bound by these Terms & Conditions.

1. About Us

Dailey’s is an online shopping and delivery platform established in 2026, currently serving customers in Keningau.

Our mission is to make daily shopping easier, more convenient, and more affordable for local communities.

2. Use of Website

By using our website, you agree that:

You are at least 18 years old or using the website under parental or guardian supervision.
The information you provide is accurate and complete.
You will not misuse the website for fraudulent, illegal, or harmful activities.

Dailey’s reserves the right to suspend or terminate access to users who violate these Terms & Conditions.

3. Orders & Acceptance

3.1 All orders placed through our website are subject to acceptance and product availability.

3.2 After placing an order, you will receive an order confirmation via email, SMS, or other communication methods.

3.3 Dailey’s reserves the right to refuse, cancel, or limit any order at our sole discretion, including cases involving:

Product unavailability
Pricing or technical errors
Suspected fraudulent activity
Payment issues

3.4 Once an order has been confirmed and processed, changes or cancellations may not be possible.

4. Pricing & Payment

4.1 Payment for all orders shall be made in Malaysian Ringgit (RM).

4.2 Dailey’s endeavours to provide you with accurate and up to date pricing, products and promotional information. However, errors may sometimes occur and we do not guarantee that the pricing, images, or other product or promotional information provided all be accurate, reliable, current, error-free, updated, or complete.

4.3 The price to be paid by you shall be based on our prevailing selling price at the time we receive your order, which may or may not be correctly reflected on the Site, App or through our Services. If a product offered by Dailey’s Mart itself is not as described, your sole remedy is to return it in unused condition.

4.4 Where the actual price of any product is dependent on its weight (“Weighed Item”), we will provide an estimate of the price based on indicated weight and our current prevailing rates at the time of checkout. The actual weight and related price of the Weighed Item will be made known to you at the time of delivery and:

4.4.1 In the event of any shortfall in payment, we reserve the right to charge you for the additional amounts; and

4.4.2 In the event of any overpayment, we will reserve or refund the excess amounts paid for such item in accordance with our prevailing refund policy at the time of delivery.

4.4.3 All product prices are shown in Malaysian Ringgit and are inclusive of Goods and Services Tax. Prices of products may change from time to time and any promotional discounts or offers may also be withdrawn at any time without notice.

4.5 Delivery charges are calculated separately during checkout based on the selected delivery option.

4.6 Full payment must be completed before the order is processed.

4.7 We accept payment for orders by E-Banking, MasterCard, Visa and PayPal only. Kindly note that PayPal, currently accepts MasterCard, Visa, American Express and Discover cards, and the credit/debit cards and payment methods accepted by PayPal is subject to change. Dailey’s Mart is unable to accept paper checks, food stamps, or third-party coupons.

4.8 By placing your order, you authorise us to transmit information or to obtain information about you from third parties from time to time and this may include verification checks involving your debit or credit card number or credit reports in order to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation, to protect you and us from fraud, and to enable us to arrange delivery of your order to your nominated delivery address.

5. Delivery Services

5.1 At present, Dailey’s currently delivers within Keningau Town area only.

5.2 Delivery slots are subject to availability.

You may also contact us at (daileyshotline@gmail.com) to check on our delivery coverage. Dailey’s will only process and accept orders within our delivery coverage.

5.3 Delivery charges vary depending on the selected delivery option and time frame.

5.4 We aim to deliver orders within the selected time frame, but delays may occur due to weather, traffic, public holidays, or other circumstances beyond our control.

5.5 No deliveries are available on Sundays and Public Holidays.

5.6 Customers are responsible for ensuring that delivery details and contact information are accurate.

5.6.1 Please notify Dailey’s immediately of any change to your delivery address, date or time of delivery, or contact number. Any changes in the delivery address or date or time of delivery after the submission of your order may incur an administrative charge of RM10.

5.7 If no one is available to receive the order during delivery, additional charges may apply for re-delivery arrangements.

5.8 Self-pickup orders must be collected within the stated collection period.

6. Product Availability & Information

6.1 All products displayed on the website are subject to stock availability.

6.2 Product images are for illustration purposes only. Actual product packaging or appearance may vary.

6.3 Dailey’s reserves the right to limit purchase quantities for selected products.

7. Returns & Refunds

7.1 Customers should inspect products upon receiving the order.

7.2 If you receive incorrect, damaged, or defective items, please contact our customer support within 3 days of receiving your order.

7.3 Approved refunds will be processed using the original payment method.

7.4 Refund processing times may vary depending on the payment provider or financial institution.

7.5 Products that have been opened, used, or damaged by customers may not be eligible for refund or exchange.

8. Privacy

Dailey’s respects your privacy and handles personal data in accordance with our Privacy Policy.

By using our services, you agree to the collection and use of your information as described in our Privacy Policy.

9. Limitation of Liability

Dailey’s shall not be held liable for:

Delivery delays caused by circumstances beyond our control
Indirect or consequential losses
Website interruptions or technical issues
Customer misuse of products

Our total liability shall not exceed the amount paid for the affected order.

All content on the Dailey’s website, including logos, text, graphics, images, and designs, belongs to Dailey’s and may not be copied, reproduced, or used without permission.

Dailey’s reserves the right to update or modify these Terms & Conditions at any time without prior notice.

Any changes will take effect immediately upon posting on the website.

These Terms & Conditions are governed by the laws of Malaysia.

Any disputes arising from the use of our website or services shall be subject to the jurisdiction of the courts of Malaysia.

To the fullest extent permissible pursuant to applicable law, Dailey’s disclaims all warranties, express or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability or fitness for a particular purpose, compliance with description, or the warranty of non-infringement. Without limiting the foregoing, Dailley’s does not warrant that the functions contained in or access to the Site, App, Services, Content or other content will be timely, quality, suitable, available, accurate, uninterrupted, error-free, or without omission, that defects will be corrected, or that the Site, App, Services, or Content are free of viruses or other harmful components, or that the download, installation or use of the App or any Content in or with any device will not affect the functionality or performance of the device.
